Buyers and sellers of companies have been using representations and warranties insurance more and more in their transactions.  However, when financing an acquisition, many lenders are not tailoring their credit documents so that they can capture the benefits of representations and warranties insurance.  Our panel covered representations and warranties insurance, and how lenders could seek to better protect their credits by tailoring provisions of their credit documents to capture the benefits.
